Terms and Conditions (AGB) — Tots in Tow

Welcome to Tots in Tow! These Terms and Conditions govern the use of our website, services, and transactions related to the rental of travel equipment and the sale of toys. By using our website and services, you agree to these terms.

1. Scope of Application

These Terms and Conditions apply to all contracts concluded between Tots in Tow, operated as a sole proprietorship under German law (hereinafter “Provider”), and its customers via the website or in connection with rental services.

By placing an order or booking a rental, the customer agrees to these Terms and Conditions.

3. Services

Tots in Tow offers:
– Short-term rental of children’s travel equipment within Hamburg, Germany (airport pickup and local delivery)
– Sale of toys and travel-related products, shipped internationally
– Digital downloadable materials

Rental services are available exclusively within the Hamburg area.
Product sales are available internationally, subject to Section 12 below.

SECTION A: RENTAL TERMS

4. Conclusion of Rental Contract

A rental contract is concluded when:
– The booking is confirmed by email, and
– The customer signs the rental agreement at pickup or delivery.

The signed rental agreement forms an integral part of the contract.

5. Rental Period

Rental periods are calculated per calendar day unless otherwise agreed. Weekly rates may be offered. If a weekly rate is selected, late returns will be charged at the standard daily rate per additional day.

6. Security Deposit

Certain rental items require a refundable security deposit. [DEPOSIT AMOUNT — TO BE CONFIRMED]

The deposit:
– Is paid at pickup or delivery
– Is refunded after inspection of the returned item
– May be partially or fully retained in case of damage, loss, or excessive wear beyond normal use

Refund processing occurs within a reasonable timeframe after return and inspection.

7. Customer Obligations

The customer agrees:
– To use rental equipment according to manufacturer instructions
– To supervise children at all times
– Not to modify or alter equipment
– To protect equipment from theft or damage

The customer is responsible for safe handling during the rental period.

8. Delivery, Pickup, and Transit Risk

Airport pickup and local delivery are available for a fee, as displayed at time of booking.

Risk of loss or damage to the equipment during transit — i.e., before the equipment is handed over to the customer, and after it has been collected from the customer at the end of the rental period — is borne by the Provider.

Once the equipment has been handed over to the customer, risk passes to the customer for the duration of the rental period, in accordance with Section 7 above.

9. Cancellation of a Booking

Standard Cancellations
Bookings may be cancelled free of charge up to 24 hours before the scheduled pickup or delivery time.

Cancellations made less than 24 hours before the scheduled pickup or delivery, or in the case of a no-show, will result in the full booking fee being retained. The security deposit, where applicable, remains unaffected and will be refunded in full, as no equipment was handed over.

Flight Cancellations and Delays
If a booking cannot be fulfilled due to a flight cancellation or significant delay, the customer may request a one-time free rebooking to a new date within 14 days of the original booking, upon providing reasonable evidence of the disruption (e.g. airline notification).

If rebooking is not possible or not desired, the standard cancellation terms above apply.

10. Return of Equipment

Equipment must be returned:
– On the agreed date
– In the condition received, allowing for normal wear

Late returns will incur additional charges at the daily rental rate. Failure to return equipment may result in invoicing of the full replacement value.

11. Damage, Loss and Repair

Any damage or malfunction must be reported immediately.

In case of damage, the Provider may charge:
– Repair costs
– Replacement costs
– Loss of rental income during repair

In cases of intentional damage or gross negligence, full replacement costs may apply.

12. Liability (Rental Equipment)

The Provider is liable in accordance with statutory German law.

The Provider is not liable for:
– Improper use of rental equipment
– Failure to follow safety instructions
– Indirect damages unless mandatory law requires liability

Parents and guardians remain fully responsible for supervising children.

SECTION B: SALES TERMS

13. Conclusion of Sales Contract

A sales contract is concluded upon order confirmation via email.

All prices include statutory VAT.

Shipping costs are displayed before checkout completion.

13a. Bundled Products (Kits)

Products sold as a “kit” or bundled set consist of multiple individual items sold together as one indivisible product, at one combined price. Kits are sold and priced as a complete set.

In the event of a withdrawal under Section 17 (Right of Withdrawal), the kit must be returned in full, including all individual items originally included. Partial returns of individual items from within a kit are not accepted, and no partial refund will be issued for individual items.

If a returned kit is incomplete or an individual item is missing or damaged beyond what is necessary to establish its nature, characteristics, and functioning, the Provider reserves the right to deduct the value of the missing or damaged item from the refund amount, in accordance with the diminished value provisions of the Widerrufsbelehrung.

14. International Deliveries

For deliveries outside Germany:
– Customs duties and import taxes are borne by the customer
– The Provider is not responsible for customs delays or additional charges imposed by customs authorities

15. Digital Downloadable Products

Digital products (e.g. downloadable materials) are made available for download immediately upon completion of payment.

By purchasing a digital product and requesting or consenting to immediate access/download, the customer acknowledges that their statutory right of withdrawal expires once download has begun, in accordance with § 356 Abs. 5 BGB. This consent will be actively requested at checkout before purchase completion.

16. Payment

Payment is due immediately upon order completion, or, for rentals, at pickup or delivery as described in Section 6.

17. Right of Withdrawal (Consumers within the EU)

Consumers have a statutory 14-day right of withdrawal for physical product purchases. The withdrawal period begins upon receipt of goods.

Digital products are subject to Section 15 above.

Rental services are excluded from withdrawal once the agreed rental period has begun, in accordance with § 312g BGB.

Returned goods must be in resalable condition. Refunds are processed after inspection. Statutory warranty rights remain unaffected.

SECTION C: GENERAL TERMS

18. Prices

All prices displayed include statutory VAT. The price valid at the time of order applies.

19. Data Protection

Personal data is processed in accordance with the GDPR and our separate Privacy Policy (Datenschutzerklärung).

Data may include: name, address, email, phone number (optional), flight details (optional, for delivery coordination).

Payment processing is handled by third-party providers. We do not store full payment information.

Marketing emails are sent only with explicit opt-in consent.

20. Account Registration

Customers may create a website account. Customers are responsible for safeguarding login credentials. The Provider reserves the right to suspend accounts in cases of misuse.

21. Force Majeure

The Provider is not liable for delays or non-performance due to events beyond reasonable control, including but not limited to natural disasters, transport disruptions, or government regulations.

22. Governing Law and Jurisdiction

Contracts are governed by German law. For merchants, the place of jurisdiction is the registered business location. For consumers, statutory jurisdiction rules apply.

23. Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

The Provider is not obliged and does not participate in dispute resolution proceedings before a consumer arbitration board.
